1. Agreement to Terms

By accessing or using Symbvia ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Symbvia provides a platform for managing business information via WhatsApp, generating structured data (Schema.org JSON-LD), and providing API endpoints for AI platforms. The Service includes:

  • WhatsApp-based interface for business data management
  • Automatic generation of Schema.org structured data
  • Real-time API endpoints for business information
  • Integration with AI platforms (OpenAI, Google, Meta)
  • Global currency and language detection

3. Service Provision "As-Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

4. Subscription and Payment

4.1 Subscription Plans

Symbvia operates on a subscription basis with no free trial. By subscribing, you agree to pay the monthly or annual fee as displayed on our website.

4.2 Payment Processing

All payments are processed securely by Stripe. You agree to provide accurate payment information and authorize Stripe to charge your payment method for the subscription fee.

4.3 Billing Cycle

Subscriptions are billed monthly or annually based on your selected plan. Fees are charged in advance for the billing period.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.

4.5 Refunds

We do not offer refunds for partial billing periods. Refunds are only provided in cases of service failure or billing errors, at our sole discretion.

5. User Responsibilities

You agree to:

  • Provide accurate and complete business information
  • Keep your WhatsApp account secure
  • Use the Service only for lawful purposes
  • Not attempt to reverse engineer or compromise the Service
  • Not use the Service to transmit harmful or malicious content
  • Comply with all applicable laws and regulations

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Symbvia and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your business data. By using the Service, you grant Symbvia a license to process, store, and display your business information as necessary to provide the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMBVIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold Symbvia harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service will cease immediately. We may delete your account and data after a reasonable retention period.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Bulgaria and the European Union, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bulgaria.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
